NOTICE OF PUBLIC HEARING Concerning the expropriation of the property by the City of Winnipeg for the purpose of widening St. James Street and St. Matthews Avenue for Polo Park infrastructure improvements, and the City of Winnipeg, in Manitoba. TAKE NOTICE that pursuant to the provisions contained in the following Statutes, namely: 1)The City of Winnipeg Charter Act, S.M. 2002 c. 39; 2)The Expropriation Act, being Cap. E 190; each, respectively, of the Continuing Consolidation of the Statutes of Manitoba, and amendments thereto, a Public Hearing will be held on the 17th day of June, 2014, at 10:00 a.m. at: The Offices of the Board of Revision, Unit 1 - 756 Pembina, Winnipeg, Manitoba The Hearing will be conducted by the undersigned Officer. The purpose of the Hearing is to inquire into whether the intended expropriation of the hereinafter-described property by the City of Winnipeg is fair and reasonably necessary for the achievement of the objectives of the City of Winnipeg. The property intended to be expropriated is legally described as follows: Firstly:The lands taken for St. James Street as shown on Plan Deposit 0086/2014 WLTO, prepared by Donald Neil Bourgeois, of the City of Winnipeg, Manitoba Land Surveyor; Secondly: The lands taken for St. Matthews Avenue as shown on Plan Deposit 0093/2014 WLTO, prepared by Donald Neil Bourgeois, of the City of Winnipeg, Manitoba Land Surveyor; In addition to any person who has been served with a Notice of Intended Expropriation, any owner whose land would be injuriously affected by the intended expropriation, or by the work for which the intended expropriation is required, shall have a right to be heard and to present evidence and argument, and to examine and cross-examine witnesses, either personally or by his counsel or agent, at the Hearing. The Inquiry Officer is required within thirty (30) days from the date of his appointment to make and deliver his report, in writing, to the confirming authority.
